Cela signifie que le prix doit comporter tout ce qui est \u00e0 la charge du constructeur.<\/p>\n<p>Il doit comprendre par exemple\u00a0:<\/p>\n<ul>\n<li>Le co\u00fbt du plan et les frais d\u2019\u00e9tude du terrain pour l\u2019implantation du b\u00e2timent,<\/li>\n<li>La garantie de livraison,<\/li>\n<li>Les taxes dues par le constructeur sur le co\u00fbt de la construction,<\/li>\n<li>Le raccordement aux divers r\u00e9seaux,<\/li>\n<li>Les travaux d\u2019\u00e9quipement int\u00e9rieur ou ext\u00e9rieur indispensables.<\/li>\n<\/ul>\n<p>Le constructeur d&rsquo;une maison individuelle ne peut pas vous facturer de suppl\u00e9ment li\u00e9 \u00e0 un al\u00e9a du sol d\u00e9couvert pendant le chantier ; il doit assumer les co\u00fbts r\u00e9sultant d&rsquo;\u00e9tudes de sol insuffisantes ou de travaux impr\u00e9vus comme des remblais ou micropieux.<\/p>\n<p>Si une partie du contrat doit \u00eatre modifi\u00e9 (vous souhaitez par exemple finalement vous charger de la pose des sols et des peintures), la signature d\u2019un avenant, pr\u00e9cisant la diminution du prix doit \u00eatre sign\u00e9.<\/p>\n<p>A l\u2019inverse, si vous exigez des prestations compl\u00e9mentaires, l\u2019avenant pourra fixer un suppl\u00e9ment financier (modification de l\u2019implantation d\u2019une pi\u00e8ce, changement de fa\u00efence\u2026).<\/p>\n<p>&nbsp;<\/p>\n<ol start=\"2\">\n<li><strong>La possible r\u00e9vision du prix <\/strong><\/li>\n<\/ol>\n<p>M\u00eame si le prix est forfaitaire et d\u00e9finitif, le contrat sign\u00e9 peut pr\u00e9voir une r\u00e9vision du prix bas\u00e9 sur l\u2019index national du b\u00e2timent tout corps d\u2019\u00e9tat (BT).<\/p>\n<p>Cette possibilit\u00e9 doit \u00eatre clairement exprim\u00e9e et d\u00e9taill\u00e9e dans le contrat.<\/p>\n<p>&nbsp;<\/p>\n<ol start=\"3\">\n<li><strong>Les travaux laiss\u00e9s \u00e0 votre charge<\/strong><\/li>\n<\/ol>\n<p>Il est fr\u00e9quent que vous souhaitiez faire vous-m\u00eame une partie des travaux pour baisser le prix de la maison\u00a0: peintures, sols\u2026<\/p>\n<p>Le constructeur a tout de m\u00eame l\u2019obligation de les inscrire dans le contrat et d\u2019estimer leur co\u00fbt.<\/p>\n<p>Cet \u00e9tape est tr\u00e8s importante. Si le constructeur ne respecte pas ses obligations sur ce point, il pourra \u00eatre contraint de les prendre en charge.<\/p>\n<p>&nbsp;<\/p>\n<ol start=\"4\">\n<li><strong>L\u2019\u00e9chelonnement des paiements <\/strong><\/li>\n<\/ol>\n<p>Le prix de la construction est vers\u00e9 progressivement, au fur et \u00e0 mesure de l\u2019avancement du chantier\u00a0:<\/p>\n<ul>\n<li>15 % au d\u00e9but du chantier<\/li>\n<li>25 % apr\u00e8s le fondation<\/li>\n<li>40 % lorsque les murs sont termin\u00e9s.<\/li>\n<li>60 % \u00e0 la mise hors d\u2019eau.<\/li>\n<li>75 % au moment de l\u2019ach\u00e8vement des cloisons et de la mise hors d\u2019air.<\/li>\n<li>95 % \u00e0 la fin des travaux de menuiserie, de chauffage, d\u2019\u00e9quipement et de plomberie.<\/li>\n<\/ul>\n<p>Naturellement, il vous est possible de visiter le chantier \u00e0 chaque appel de fonds pour vous assurer que les travaux factur\u00e9s ont bien \u00e9t\u00e9 r\u00e9alis\u00e9s.<\/p>\n<p>Le solde du prix sera vers\u00e9 uniquement dans un d\u00e9lai de huit jours apr\u00e8s remise des cl\u00e9s et r\u00e9ception sans r\u00e9serves, ou \u00e0 la lev\u00e9e des r\u00e9serves si elles ont \u00e9t\u00e9 formul\u00e9es.<\/p>\n<p>En cas de r\u00e9serves \u00e0 signaler lors de la r\u00e9ception, les 5% de solde doivent \u00eatre consign\u00e9es.<\/p>\n<p>Je vous rappelle que le constructeur a l\u2019interdiction de subordonner la remise des cl\u00e9s au paiement de ces 5%.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>La souscription du \u00ab kit CCMI \u00bb vous permet, \u00e0 tout moment des travaux, d\u2019interroger le cabinet sur toutes vos questions relatives aux aspects financiers du contrat.
